1. Agreement to Terms

By accessing and using Tech Monal's services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

Tech Monal provides enterprise backend infrastructure solutions for affiliate networks, payment processing, VAS platforms, and traffic brokering. Our services are provided on an "as-is" and "as-available" basis.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. API Usage and Limitations

You agree to use our API in compliance with all applicable laws and regulations. You may not:

• Reverse engineer or attempt to bypass security measures
• Use the API to develop competing services
• Exceed rate limits specified in your service tier
• Store sensitive data in violation of PCI-DSS standards
• Use the service for illegal activities or fraud

5. Service Level Agreement (SLA)

Tech Monal maintains a 99.99% uptime SLA for all production services. Planned maintenance windows are excluded. In the event of SLA breach, eligible customers may request service credits as outlined in their service agreement.

6. Payment Terms

All fees are exclusive of applicable taxes. Payment is due within 30 days of invoice unless alternative terms are agreed upon. Failure to pay may result in service suspension or termination.

7. Intellectual Property Rights

All content, features, and functionality of Tech Monal services are owned by Tech Monal, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, and other intellectual property laws.

8. Limitation of Liability

In no event shall Tech Monal be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the fees paid by you in the preceding 12 months.

9. Indemnification

You agree to indemnify and hold harmless Tech Monal from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of third-party rights.

10. Termination

Either party may terminate this agreement with 30 days written notice. Tech Monal may terminate immediately if you violate these terms. Upon termination, all rights to use the service are immediately revoked.

11. Modifications to Terms

Tech Monal reserves the right to modify these terms at any time. We will notify you of changes via email. Your continued use of the service constitutes acceptance of the new terms.

12. Governing Law

These terms are governed by and construed in accordance with the laws of India, and you irrevocably submit to the exclusive jurisdiction of the courts located in India.
